Terms of Service

1. Agreement and eligibility

These Terms of Service (“Terms”) govern your access to CourtWiz at courtwiz.app and related services operated by Lefty Software LLC (“CourtWiz,” “we,” “us,” or “our”). By creating an account, accepting an invitation, responding to an RSVP, or otherwise using CourtWiz, you agree to these Terms and our Privacy Policy.

You must be at least 13 years old and legally capable of agreeing to these Terms. If you use CourtWiz for an organization or another person, you represent that you have authority to do so.

2. What CourtWiz provides

CourtWiz helps people organize courts, players, groups, matches, invitations, availability, RSVPs, and calendar information. CourtWiz is a coordination tool. We do not own or operate the courts shown in the service, reserve courts on your behalf, select participants, supervise matches, or guarantee that a venue, player, or match will be available.

Features may change as the service develops. We may modify, suspend, or discontinue a feature when reasonably necessary for security, maintenance, legal compliance, or operation of the service.

3. Accounts and account security

• Provide accurate, current information and keep it updated.
• Protect your password, passkeys, authentication factors, recovery codes, and signed links.
• Do not share an account or use another person’s account without permission.
• Notify us promptly at [email protected] if you suspect unauthorized access.

You are responsible for activity performed through your account unless applicable law provides otherwise. We may require email verification or recent authentication before sensitive changes.

4. Player rosters, groups, and user content

You retain ownership of information you submit. You grant us a limited, nonexclusive license to host, copy, process, and display that information only as needed to operate, secure, and improve CourtWiz.

When you add another person’s name, email address, phone number, availability, or other information, you represent that you have a legitimate reason and permission to use it for organizing play. Do not upload sensitive information that CourtWiz does not request.

Public groups and public court locations may be visible to signed-in CourtWiz users. Private-group information is intended for that group’s members and administrators. Match details and RSVP options may be disclosed to invited players through personalized links. You are responsible for choosing appropriate privacy settings and recipients.

5. Email and service communications

You authorize CourtWiz to send transactional messages needed to provide the service, including invitations, RSVP requests, match updates, reminders, account verification, sign-in, password-reset, and security notices. Organizers may cause CourtWiz to send invitations to people who do not yet have accounts.

Notification emails include an unsubscribe option where appropriate. Unsubscribing from match notifications does not prevent essential account-security or legally required messages.

6. Acceptable use

You may not:

• Use CourtWiz unlawfully, deceptively, abusively, or to harass or endanger another person.
• Add people to rosters, groups, or messages without a legitimate scheduling purpose.
• Scrape, harvest, sell, or misuse player, group, location, or match information.
• Probe or bypass access controls, rate limits, privacy settings, signed links, or security measures.
• Upload malicious code, interfere with the service, or use automated access without written permission.
• Impersonate another person or misrepresent your affiliation, authority, availability, or match information.

7. Courts, participants, and physical activity

You are responsible for confirming reservations, rules, fees, weather, accessibility, equipment, participants, and safety directly with the venue and players. Racquet sports and travel to or from matches involve risks of injury and property loss. Participate according to your own judgment and obtain professional advice when appropriate.

8. Third-party services and links

CourtWiz may use or link to third-party services, including Google Sign-In, Google Maps Platform place information, calendar applications, and email providers. Your use of third-party services is governed by their terms and privacy policies. Google-powered features are also subject to the Google Terms of Service and Google Privacy Policy.

We are not responsible for third-party venues, services, content, availability, or conduct.

9. Suspension, termination, and deletion

You may stop using CourtWiz at any time and may request account deletion by contacting us. We may restrict or suspend access when reasonably necessary to protect users or the service, investigate abuse, comply with law, or enforce these Terms. Where practical, we will provide notice and an opportunity to correct the issue.

Deletion may not remove information that other users independently supplied, information preserved in group or match history, or records we must retain for security, legal, or operational reasons. Our Privacy Policy explains retention in more detail.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTWIZ IS PROVIDED “AS IS” AND “AS AVAILABLE.” LEFTY SOFTWARE LLC DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, DATA, COMMUNICATIONS, OR SIGNED LINKS WILL ALWAYS BE ACCURATE, AVAILABLE, SECURE, OR ERROR-FREE.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

11. Limitation of liability and indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEFTY SOFTWARE LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, GOODWILL, OR USE, ARISING FROM COURTWIZ, A VENUE, A MATCH, ANOTHER USER, OR THIRD-PARTY SERVICES.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO COURTWIZ WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR COURTWIZ DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limitations apply only to the extent permitted by law.

You agree to indemnify and hold Lefty Software LLC harmless from third-party claims arising from your unlawful use of CourtWiz, your content, your violation of these Terms, or your violation of another person’s rights, except to the extent caused by our own wrongful conduct.

12. Changes, governing law, and general terms

We may update these Terms. If a change materially affects your rights, we will provide reasonable notice through CourtWiz or by email when appropriate. Continued use after the effective date of revised Terms constitutes acceptance.

Florida law governs these Terms without regard to conflict-of-law principles. Any dispute not subject to a mandatory alternative forum must be brought in a state or federal court with jurisdiction in Florida, and each party consents to that forum, except where applicable consumer law requires otherwise.

These Terms and the Privacy Policy are the entire agreement concerning CourtWiz. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, or sale of the service.
